These terms of use (the "Terms") govern access to and use of the street-artwork.com website and of the Street Artwork mobile application (together, the "Service"), published by Alexandre Rabottin (the "Publisher"), 4 allée Richemont, 44000 Nantes, France, contact@street-artwork.com.
By creating an account, signing in or using the Service, you agree to these Terms without reservation. If you do not accept them, do not use the Service.
ARTICLE 1 - YOUR ACCOUNT
You must be at least 13 years old to create an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for any activity carried out from your account. One account per person; impersonating someone else is prohibited.
ARTICLE 2 - USER-GENERATED CONTENT - ZERO TOLERANCE
The Service lets you publish content: photographs of street art, titles, locations, artist profiles and profile information ("User Content"). You remain responsible for what you publish and warrant that you hold the rights required to do so.
The Publisher enforces a zero-tolerance policy towards objectionable content and abusive users. It is strictly prohibited to publish, transmit or distribute through the Service:
- hateful, discriminatory, racist, sexist or homophobic content, or content inciting hatred or violence;
- pornographic or sexually explicit content, and any sexual content involving minors;
- violent, shocking or degrading content, or content glorifying terrorism or crime;
- harassing, threatening or defamatory content, or content infringing someone's privacy;
- unlawful, misleading or fraudulent content, spam or unsolicited advertising;
- content infringing a copyright, a trademark or any other third-party right;
- personal data of third parties published without their consent.
Photographs must depict street art visible from public space. Photos of identifiable people, content unrelated to street art, and pictures taken in breach of private property are rejected.
ARTICLE 3 - MODERATION, REPORTING AND ENFORCEMENT
Pre-publication moderation. Every artwork and artist profile submitted is reviewed by moderation before publication. It only becomes publicly visible once approved, which filters out objectionable content upfront.
Reporting. Every artwork and artist profile carries a "Report" function, available in the app and on the website, to bring content to the attention of moderation (objectionable content, copyright infringement, spam, incorrect information, other reason).
Action within 24 hours. The Publisher undertakes to review any report of objectionable content within 24 hours of receipt, to remove the content if it breaches these Terms, and to suspend or delete the account of the user who provided it.
Blocking. You can block another user from the app. Content from a blocked user disappears immediately from the lists, the map and the results you see. Every block is reported to moderation, which reviews the targeted account.
Enforcement. In the event of a breach of these Terms, the Publisher may, without notice and at its sole discretion, remove content, restrict access to the Service, suspend or permanently delete the account concerned, and report the facts to the competent authorities where required by law.
ARTICLE 4 - RIGHTS IN CONTENT
You retain your rights in the User Content you publish. By publishing it, you grant the Publisher a free, worldwide, non-exclusive licence to reproduce, display and adapt it, solely for the purpose of operating, promoting and distributing the Service, including on its social media channels. Detailed intellectual property terms are set out in the legal notice.
ARTICLE 5 - ACCOUNT DELETION
You can delete your account at any time, directly in the app (Options → Settings → Delete my account) or from your account area on the website. Deletion is permanent and erases your personal data (email address, profile, avatar, preferences, notifications, likes) and cancels any ongoing subscription. Artworks and artist profiles already published are kept in the catalogue but permanently detached from your identity. See the data deletion page.
ARTICLE 6 - SUBSCRIPTIONS
Some features are reserved for paid plans. Payments are processed by Stripe. Recurring subscriptions can be cancelled at any time from the management portal available in the app; cancellation takes effect at the end of the current period.
ARTICLE 7 - LIABILITY
The Service is provided "as is". The Publisher does not warrant the accuracy of information published by users, in particular artwork locations, which may be wrong or out of date. It is your responsibility to travel safely and to comply with applicable regulations and with private property. The Publisher cannot be held liable for damages arising from use of the Service.
ARTICLE 8 - PERSONAL DATA
The processing of your personal data is described in the privacy policy.
ARTICLE 9 - CHANGES TO THE TERMS
The Publisher may amend these Terms to reflect changes to the Service or to applicable regulations. The date of the last update appears at the top of this page. Continued use of the Service after a change constitutes acceptance.
ARTICLE 10 - GOVERNING LAW
These Terms are governed by French law. Any dispute falls under the jurisdiction of the French courts, subject to mandatory consumer protection rules.
